State Law Privacy Notice

This State Law Privacy Notice (this “Notice”) supplements the Privacy Policy and applies solely to residents of California, Oregon, and Minnesota (“Applicable State Privacy Laws”).

Pursuant to Applicable State Privacy Laws, this Notice provides additional details regarding our collection, use, and disclosure of residents’ personal information that is subject to these laws. This Notice also describes the rights available in relation to certain personal information we maintain and how consumers can exercise those rights.

Capitalized terms used but not defined in this Notice have the definitions ascribed to them in the Privacy Policy.

NOTE: LendingTree is a financial institution subject to the federal Gramm-Leach-Bliley Act (“GLBA”). The Applicable State Privacy Laws and this Notice do not apply to personal information we collect, maintain, use, or disclose to the extent such information is governed by or subject to the GLBA and related regulations. For example, personal information relating to consumers who use the Services to initiate or complete the process of requesting or applying for financial products or services, including loans and insurance, is governed by the GLBA and exempt from the Applicable State Privacy Laws. This means the Applicable State Privacy Laws do not require LendingTree to honor consumer privacy rights requests with respect to this personal information. This Notice applies only to residents of California, Oregon, and Minnesota whose interactions with us are limited to:

• Visiting the Digital Properties;
• Signing up for our email alerts;
• Utilizing chatbot technology on the Digital Properties;
• Commenting on or contributing to our blogs; and/or
• Establishing an account that does not include a financial product or service subject to the GLBA.

B. Purposes For Collecting and Processing Personal Information

Communicating with you, including to contact you for administrative purposes (e.g., to provide the Services and information that you request or to respond to your comments and questions) or to send you important updates and communications about this Notice and/or other applicable terms and conditions.

Sending you marketing and promotional communications, including emails about products or services that may be of interest to you. Personalizing the Services, including to tailor the content we may send or display to you and otherwise personalize your experience with us.

Engaging in interest-based targeted advertising, including to serve you interest-based advertising on the Digital Properties or on other online services across the devices you may use. Conducting research and analytics to develop and improve the Services, including to analyze usage trends and preferences in order to improve the Services and develop new products, services, and features.

Satisfying our legal obligations, including complying with applicable law and responding to lawful requests and communications from law enforcement authorities and other government officials.

Supporting our business operations and business transactions, including to administer our general business and other related functions and to carry out sales or other business transactions.

C. Retention

We will retain your personal information at least as long as necessary to fulfill the purposes of processing listed in this Notice.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of personal information; the potential risk from deletion, unauthorized use, or disclosure of the personal information; the purpose(s) for which we use or may use the personal information; whether we can achieve the purpose(s) through other means; and applicable legal requirements.

DISCLOSURES OF PERSONAL INFORMATION

We may disclose each category of personal information we collect from and about you with the following categories of recipients:

Our Affiliates and Subsidiaries. We may disclose your personal information to other entities within our family of brands to fulfill any purpose described in this Notice and our Privacy Policy.

Our Business Partners. We may disclose your personal information to other companies with whom we partner to provide the Services and carry out other activities described in this Privacy Policy.

Our Service Providers. We may disclose your personal information to third parties that provide business, professional, or technical support services to us and/or administer activities on our behalf.

Our Analytics Providers. We may disclose your personal information to parties that assist us in performing analytics and help us measure the effectiveness of the Services and our marketing and advertising efforts.

Our Marketing and Advertising Partners. We may disclose your personal information to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving, measuring the performance of, and optimizing our advertisements.

Governmental and Public Authorities. We may disclose your personal information to government and public authorities as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or similar request from a self-regulatory body or government agency.

Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

Other Parties. We may disclose your personal information to other parties as we believe necessary or appropriate either to: (1) comply with applicable law; (2) protect our operations and those of our affiliates and subsidiaries; (3) investigate and prevent against fraud and other illegal activity; (4) protect our rights, privacy, safety, property, and/or those of others; or (5) allow us to pursue available remedies or limit damages that we may sustain.

We may disclose your personal information for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal information with your consent or when you direct us to do so. We may de-identify, anonymize, or aggregate personal information and disclose such information to third parties for various purposes as permitted by law.

SALE AND SHARING OF PERSONAL INFORMATION

We “sell” and “share” (as such terms are defined in Applicable State Privacy Laws) certain categories of personal information to and with third parties. Additionally, as detailed in the chart above, we have “sold” and “shared” certain categories of personal information in the past twelve (12) months for analytics and “targeted advertising” purposes. Refer to the chart above for additional details. We do not “sell,” “share,” or use for “targeted advertising” the personal information of minors we know to be under the age of 18.

YOUR LEGAL RIGHTS

Depending on your state of residence, Applicable State Privacy Laws may provide you the rights listed below. Note that not every Applicable State Privacy Law grants each of these rights, and each Applicable State Privacy Law exempts from these rights and requests certain information we collect, including information governed by or subject to the federal GLBA. We reserve the right to honor requests only to the extent required by applicable law. Applicable State Privacy Law may grant you the following rights:

• The right to request the following information covering the twelve (12) months preceding your request:

      o the categories of personal information we have collected about you and the categories of sources from which we collected such information;
      o the specific pieces of personal information we have collected about you;
      o the business or commercial purposes for collecting, selling, or sharing your personal information;
      o the categories of third parties to whom we disclosed such personal information; and
      o if we sold, shared, or disclosed your personal information for a business purpose, two separate lists disclosing:

       ▪ sales and shares, identifying the personal information categories that each category of recipient received; and
       ▪ disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

• The right to request a specific list of third parties with whom we have shared your personal information, excluding natural persons and/or trade secrets.

• The right to delete personal information that we have collected from you, subject to certain exceptions, including, but not limited to, where such information is reasonably necessary to help ensure security and integrity or debug to identify and repair errors that impair existing functionality.

• The right to correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing.

• The right to opt out of certain types of personal information uses, including the “sale” or “sharing” of your personal information, or the use and disclosure of your personal information for “targeted advertising” (as these terms are defined in Applicable State Privacy Laws).

We will not discriminate or retaliate against you if you decide to exercise your rights under Applicable State Privacy Laws.

Where permitted by law, we may elect to delete personal information as an alternative to correcting information if the deletion does not negatively impact you or you consent to the deletion.

When you exercise the right to know, the right to request a specific list of third parties, the right to delete, or the right to correct, Applicable State Privacy Laws permit us to take steps to verify your identity. To protect consumer privacy, we will require the matching of at least three pieces of information provided with your request with information we maintain to verify that it is you making the request. Where applicable, we will use the requested information for verification purposes only. Note that we may decline a request where we are unable to verify your identity and confirm the personal information we maintain relates to you. You have the right to appeal our rejection of your request through the same mechanism by which you made the initial request. Additionally, we reserve the right to honor requests to access, correct, or delete personal information only to the extent required by applicable law.

AUTHORIZED AGENTS

You may authorize someone to submit a privacy rights request on your behalf (an “authorized agent”). An authorized agent will need to demonstrate that you have authorized them to act on your behalf, unless you have provided the agent with power of attorney pursuant to applicable probate law. Depending on the evidence provided, we may contact you to verify your identity with us or request confirmation from you that the agent is authorized to submit the request on your behalf.

EXERCISING YOUR SALE, SHARING, AND TARGETED ADVERTISING OPT-OUT RIGHTS

As detailed in the chart above, we “sell” and “share” certain categories of personal information to and with third parties, including for “targeted advertising purposes” as defined in applicable law. CHANGES TO THIS NOTICE

We may update this Notice from time to time to reflect changes in our information-handling and privacy practices and/or changes in applicable law. The “Last Updated” date at the top of this page indicates when this Notice was last revised. If we make changes, we will provide appropriate notice to you. Such notice may be provided via a temporary banner on our Site, an email sent to users for whom we have an email address, or by temporarily noting “Updated” next to the Privacy Policy link on the footer of our Site. We encourage you to review this Notice periodically to remain informed about our information handling and privacy practices. By visiting or using our Digital Properties, you agree that any changes to this Notice shall apply to any personal information we may maintain about you, whether collected before or after such changes.
