Privacy Notice for LendingTree Job Applicants and Employees who are California Residents

Pursuant to the California Consumer Privacy Act (“CCPA”), we provide this CCPA Notice to California residents who are job applicants and/or employees (collectively, “California Employees”) of LendingTree, LLC, and its subsidiaries (collectively, “LendingTree,” “us”, “we”, or “our”). This Notice explains how we collect, use, and share personal information of California Employees as part of the recruitment, application, hiring, onboarding, and/or employment processes, and the rights and choices we offer California Employees regarding our handling of their personal information. The term “personal information” is used in this CCPA Notice in accordance with the CCPA.

Certain categories of information may be collected when you apply for a position, and other categories of information may be collected as part of the hiring, onboarding, and/or employment process. Disclosure practices with respect to personal information collected: We may disclose each category of personal information collected with service providers, including background check and drug testing companies, human resource and benefits-related service providers, and external advisors. In certain circumstances, we may also disclose each category of personal information with governmental organizations or agencies, including where required by law.

For those who visit our websites or use our apps (for example, if applying for a job), we may “sell” or “share” your identifiers and internet or other electronic network activity information in connection with such usage for marketing and advertising purposes to the following parties:

  • Our analytics providers; and
  • Our marketing and advertising partners (including social media platforms and third-party advertising networks).

We do not knowingly “sell” or “share” the personal information of minors under the age of 16.

We may make some personal information public at your direction.

How long we retain personal information collected: The length of time we retain your personal information depends on several criteria, including but not limited to the length of time we are required to retain information to comply with legal obligations or assert legal rights; the length of time we believe is reasonably necessary to respond to, or defend our rights in the context of, a state or federal regulatory inquiry or investigation; and the length of time we may need to retain information to conduct business or accomplish the business purpose(s) for which the information was collected.

Explanation of Your CCPA Privacy Rights: The CCPA grants California residents the following rights:

Access/Know. You can request to know the personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you. Please note that we may not be required to respond to your requests “to know” or access specific pieces of personal information more than twice in any 12-month period.

Correction. You can ask us to correct inaccuracies in personal information we maintain about you.

Deletion. You can ask us to delete personal information we collected or maintain about you.

Opt Out of Sell or Share: You can opt out of the “sale” or “sharing” of your personal information (as these terms are defined in applicable law).

Please note that the CCPA and other applicable laws may limit these rights by, for example, prohibiting us from providing certain personal information in response to an access request or limiting the circumstances in which we must comply with a deletion, correction, or limitation request. We will respond and/or take action in response to requests to exercise these rights only to the extent required by law. We may request certain information to verify your identity before we can respond to your privacy rights request.  If we deny your request, we will communicate our decision to you. You are entitled to exercise the rights described above free from discrimination or retaliation.

We will require the authorized agent to have a written authorization confirming that authority. We may deny your request if we cannot verify your or your agent’s identity using commercially reasonably methods (other than for opt out or limitation requests).

CCPA Scope and Exclusions: This CCPA Notice applies only to California residents whose interactions with us are limited to applying for open job positions or being employed by LendingTree. Note that LendingTree is a financial institution subject to the Gramm-Leach-Bliley Act (“GLBA”). The CCPA and this CCPA Notice do not apply to any of our activities or services or personal information we collect, use, or disclose to the extent such activities, services, or information are governed by or subject to the GLBA and related regulations. For example, information related to consumers who initiate or complete the process of requesting or applying for financial products or services using our websites or services is subject to the GLBA or the California Financial Privacy Act and exempt from the CCPA. Changes to this Notice:  We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this CCPA Notice at any time. We will communicate any revisions and post the revised policy internally.
